Terms and Conditions

Welcome to aunicajpay.com your gateway to the complete Aunicaj Business System hereafter referred to as The System. The System gives you complete online access to all the business applications you are entitled to as a subscriber.  It allows you seamless connection to all the portals you need to provide all the services to your clients.  In order to insure uninterrupted and efficient conduct of your business within The System, we require all users to read, understand and abide by the following Terms and Conditions.

 

USE OF THE SYSTEM

The System shall solely be used by registered subscribers or those whom they authorize on their behalf.

In order to insure proficiency in using The System, all users are required to undergo systems training provided by Aunicaj free of charge to all subscribers and/or their authorized representatives.

Use of The System shall only be for the expressed purpose of conducting the businesses offered by Aunicaj.  Any unauthorized uses shall be subject to legal actions if warranted. Any of the following actions shall be deemed illegal and be subject to proper corrective and/or legal actions:

  • Tampering or altering any part of The System including any of its peripheral applications and/or links to any of its social media accounts;
  • Posting links to any obscene, pornographic, indecent, lewd, violent, profane, racist, discriminating, insulting, threatening, or objectionable posting/material that could be considered harmful;
  • Posting or linking false, malicious and libelous posts/materials;
  • Posting or linking materials that infringe or violate any intellectual property(ies) or other rights of other entities or persons;
  • Knowingly do anything that will damage The System or cause it to malfunction or in any way interfere with its orderly operation or hurt its integrity and reputation;

As The System includes website links and portals to all of Aunicaj’s partners and service providers, all users are bound by the same rules stipulated above and elsewhere in this document and in any other policies both existing and those that may be formulated in the future regarding the conduct of business within the Aunicaj system, shall also apply in the use of said links and portals.

By logging in on The System, you signify your acceptance of all the terms and conditions herein stipulated. This terms and conditions may be revised or altered by Aunicaj as it deems necessary and it is the responsibility of all users to update themselves on all changes which will be posted on this site from time to time.

  

PRIVACY POLICY

All personal information and/or records supplied to Aunicaj will not be disclosed unless covered by a written permission from subscribers or legally required by law.

 

SUPPLIERS TERMS AND CONDITIONS

Additional terms and conditions may apply on the travel products, bookings, telco products and services you process through The System. For your guidance, refer to their specific terms and conditions prior to completing your transactions. These additional conditions may include, but not limited to, rules and restrictions in terms of cancellations and/or amendments, fare validity, promo periods, availability, check-in/checkout and block-out dates and/or baggage allowance policies. We shall not be liable for any loss or damages you may sustain in your failure to comply with their respective rules and regulations as may be applicable.

 

E-MONEY FUNDING

There is a list of six Aunicaj depository banks somewhere in this website.  You can use any one of them to deposit funds for your E-Money. You will need a picture of your bank transaction report to be uploaded to the system for your transaction to be validated and your deposit to be credited to your E-Money fund otherwise your transaction will not succeed and you will receive a “Failed” message.  Funding requests will be processed 9:00 AM to 6:00 PM Monday to Saturday only.

In the event that subscribers want to withdraw their E-Money fund, a written request should be filed to Aunicaj accounting department. A two-week period is required for processing the request and a check will be issued.  If direct deposit to a bank account is preferred, a fee of PhP 100 will be charged.

BILLS PAYMENT

Actual Statement of Account (SOA) must be present when processing Bills Payment.  Only bills that are at least 3 days before due date can be paid through The System.  Transactions posted completed before 3:00 PM will be processed with the Billers on the same day. Transactions posted after 3:00 PM will be processed the next working day. Any problems that may arise by not observing the above procedures shall solely be the responsibility of the subscribers to their client and not of Aunicaj.

 

BOOKING

Airlines

As a general rule, air tickets are non-transferable. Airlines may offer fares which are neither refundable nor changeable. Some changes, if permitted, may require additional fees. These include, but are not limited to, rebooking, re-routing, refunding, name change, additional services, upgrades, and other similar changes. Aunicaj reserves the right to collect the said fees from the subscriber when applicable. Personal requests such as seat assignment, special meals, wheelchair assistance, and other special needs will not be guaranteed by Aunicaj but should be coordinated with the particular airline directly. Aunicaj applies a certain service fee for all airline ticketing transactions, and may or may not appear in the ticket price in your electronic ticket. Aunicaj shall not be liable for any loss or damages you may sustain due to the acts or omissions of the airlines in their transactions with you. Aunicaj as medium for airline booking is not liable for delayed, rescheduled or canceled flights so the subscriber must monitor the status of their bookings from time to time. Bookings completed through Aunicaj’ reservation agents, will be charged a fee of Php100.00/way/pax (One Hundred pesos per way per pax).

Hotels

Other hotels may require guests to present their credit card or deposit cash upon or prior to their check-in. This is to cover additional expenses that may occur during their check-in period. This deposit is independent from any payment for your hotel booking you made on the System. Additional expenses must be settled with the hotel upon check-out. The hotel will determine if the stay is late check-out or early check-in depending on the room availability. The guest must coordinate directly to the hotel supplier or operator for any special requirements such as accessible rooms, baby needs, dietary requirements or request to accommodate additional person in the room. Aunicaj is not liable for any damages or loss you may sustain due to the action/decision of the hotels in their transactions with you.

Car Rentals

Car rental terms and conditions, procedures, policy and requirements vary per our rental company partners/supplier. It is advised that you check the terms and conditions of the specific car rental service provider indicated in the system generated voucher issued by The System before confirming your reservation.

 

 

Cancellation and Changes

  1. Hotel bookings – Aunicaj is relying on cancellation policy of your chosen hotel, which is posted on their respective system or pages. For further clarification and bookings changes and clarifications, please refer to the policy of your chosen hotel or contact the same before you book.
  1. Airline bookings – For the cancellation and amendment of Airline bookings, the applicable terms and conditions of the particular airline shall apply. You should contact the airline directly or contact our customer service assistance to cancel or make amendments to your bookings. As a general rule, promo’s or fares for low cost flights are non-refundable. In the event that you decide to cancel your booking/ low cost flight, our booking fee and any amendment charges are non-refundable.
  1. Car rental – Please refer to the applicable Supplier’s terms and conditions for cancellation charges and other important terms and conditions relevant to your car rental booking.
  1. No show – In case of a confirmed booking and you failed to show up to check-in, collect the car or van or otherwise do not avail yourself of such product or service, you will not be entitled to any refund from Aunicaj unless the Service provider allows refunds. If ever allowed, the net amount refundable to you will be the net of whatever is allowed by the Service provider after deductions of Aunicaj standard service charges. Said amount will be credited back to your E-wallet once Aunicaj receives the same from the Service provider.
  1. Miscellaneous – You acknowledge that some service providers will have required you to be bound by their own terms, conditions, rules and restrictions, (including limitation, rules of conduct and behavior) and/or to sign their liability waiver before engaging in the service and/or activity you avail of. You understand that violation of any service provider terms, conditions, rules, and restrictions may result to (i) cancellation of your reservation(s), (ii)restriction to the applicable travel product or services, (iii) forfeiture of any reservation(s) without refund, and/or (iv) charging or debiting your card/account/cash deposits for any costs we incur as a result of such violation.

 

 

TRAVEL DOCUMENTS AND ADVISORIES

It is deemed that by booking your flights on The System, you will provide correct and accurate details regarding yourself and your travel companions, and you will be able to present a valid government-issued ID or Passport. You undertake that you and your travel companions have the legal requirements needed to travel to your chosen destination, and stay for the duration of your travel. Foreign nationals travelling to the Philippines are required to have a Passport, and/or other travel documents required by the relevant government agencies. For further information, see Philippine Bureau of Immigration website (www.immigration.gov.ph). Aunicaj shall not be held liable for losses or damages you and your travel companion may incur as a result of your failure to secure and/or present all required travel documents.

For destinations that require special documents (ex. Visa) upon entry, the passenger is solely responsible to meet such prerequisite. Please note that aunicaj.com does not guarantee full refund on cancellation of ticket in case the passenger fails to obtain required documents. Ticket refund request is subject to airline’s applicable fare rules on ticket purchased.

While The System provides options for travel destinations, we cannot guarantee that these destinations are risk-free. We strongly advise you to read travel advisories, warnings, prohibitions and announcement issued by the respective governments. Similarly, we encourage you to check weather forecasts to make necessary precautions. Useful information may also be found from the Government of the Republic of the Philippines in coordination with the Philippine Department of Foreign Affairs (www.dfa.gov.ph) and the Department of Tourism (www.tourism.gov.ph) prior to booking travel to/from the Philippines. We shall not be held liable for any accidents, property damages, injuries, death, or any other losses that may result during your travel on flights, or stay at hotels, and/or availing of other tour components or services such as car rentals, land tours, etc. booked through The System.

COMPLETION AND PAYMENTS

If you use The System for business, you undertake that you are authorized to create bookings for client and shall be responsible in providing correct and accurate details required for their booking/s or transaction/s. Aunicaj is not liable for any losses or damages incurred as a result of any of your action, inaction, mistake or omission.

In order to make a booking/transaction, you and your client must be of legal age (at least 18 years old), knowledgeable and capable of entering a contract and this Agreement. You are deemed financially responsible for all transactions completed under your account.

The System displays rates in Philippine Pesos (PHP) that will directly be debited on your Electronic Wallet (E-Money) when you attempt to complete a transaction. Insufficient balance in your wallet will not complete your transaction and there is no assurance that the prices will remain the same when you re-do the transaction as our Service providers do change their rates without prior warnings from time to time.

REFUNDS

If applicable, Aunicaj will process refunds upon request by subscribers on behalf of their client provided they present a written or verbal authorization from their clients holding the reservations. If another person other the subscriber and/or the passenger or guest holding the reservation would request processing of a refund, a letter of authorization together with a valid ID of the passenger, should accompany the request.

Each supplier/partner of Aunicaj has its own refund policy. In case Aunicaj is allowed to process the refund, we will inform the subscriber on the corresponding waiting time for the refunds to be issued.

Refunds are subject to penalties levied by the supplier, based on the terms and conditions made at the time of booking. Aunicaj charges a minimal service fee for all refund transactions. The net refund will be credited directly on the subscriber’s electronic wallet (E-Money) once Aunicaj receives the same from Service providers.

SUSPENSION OR TERMINATION OF ACCOUNT

At the sole discretion of Aunicaj, it may suspend or terminate any subscriber account if deemed appropriate. Inappropriate acts or misuse and/or any infringement of The System’s legal and intellectual property rights can be ground for such punitive actions.

COPYRIGHT/TRADEMARKS

www.aunicaj.com and app.aunicaj.com contents are protected by a copyright, The blue and green logo with the tag line “ Your Dreams Are Real” is a trademark of Aunicaj International Trading Corporation. Any unauthorized use of such properties is deemed illegal and Aunicaj will not be liable for any damage to anybody that may arise from such actions. All subscribers are required to report any such illegal actions if encountered.

GENERAL TERMS OF LIABILITY AND DISCLAIMER

Subscriber acknowledged that Aunicaj is acting as a mere aggregator agent for services provided by various Suppliers/Service Providers, that all products and services processed through The System are sold to Customer by said Suppliers/Service Providers and not by Aunicaj. Aunicaj will have no liability to Customer for (i) any failure of the systems of Aunicaj or any third party that results in the failure or the inability to process a transaction through Aunicaj, or (ii) the quality of the products and services provided by Suppliers/Service Providers to Aunicaj.

Aunicaj does not guarantee, and is not liable, for any inaccuracies and errors relating to the travel products and services displayed on The System from our Suppliers/Service Providers. These may include errors on availability, pricing, general product descriptions, photographs, list of amenities and inclusions. Aunicaj and its Suppliers/Service Providers reserve the right to change any reservations made under an incorrect price, for which you may be given the option to accept or get refund without penalty.

Aunicaj and/or its Suppliers/Service Providers may make improvements and/or changes on The System at any time. Aunicaj does not guarantee uninterrupted access to The System. For major updates and system maintenance, a notification/announcement will be posted sufficiently ahead of time.

All products and services contained in The System and of its Suppliers/Service Providers are provided “as is” and no warranties of any kind or nature is implied by Aunicaj or its Supplier/Service Provider unless specifically indicated. Aunicaj or its Suppliers/Service Providers make no representations about the suitability of the information, software, products, and services contained in The System for any purpose, and the inclusion or offering of any products or services on this website does not constitute any endorsement or recommendation of such products or services by us.  Aunicaj and/or its Suppliers disclaim all warranties and conditions that this website, its servers or any email sent from Aunicaj and/or its Suppliers are free of viruses or other harmful components. Aunicaj and/or its Suppliers hereby disclaim all warranties and conditions with regard to this information, software, products, and services, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title, and non-infringement.

The Suppliers providing travel services and/or products offered on The System are independent contractors. Aunicaj does not in any way own, manage, operate or control any of the Suppliers. We are not liable for any acts, errors, omissions, representations, warranties, breaches or negligence of any of our Suppliers or for any loss, property damage, injuries, death, or other damages/expenses resulting therefrom. Aunicaj will not be held liable and shall make no refund in the event of any delay, cancellation, overbooking, strike, force majeure, disconnection of utilities or other causes beyond their direct control, and they have no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority.

In no event shall Aunicaj and/or their respective Suppliers/Service Providers be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of, or in any way connected with, your access to, display of or use of The System or with the delay or inability to access, display or use The System (including, but not limited to, your reliance upon opinions appearing on this system; any computer viruses, information, software, linked System, products, and services obtained through this website; or otherwise arising out of the access to, display of or use of this system) whether based on a theory of negligence, contract, tort, strict liability, or otherwise, and even if Aunicaj and/or its Suppliers/Service Providers have been advised of the possibility of such damages.

If, despite the limitation above, Aunicaj and/or its Suppliers/Service Providers are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then the liability of Aunicaj and/or its Suppliers/Service Providers will in no event exceed, (a) the total payment made to Aunicaj, or (b) Php5000.00.

The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in this Agreement is found to have failed of its essential purpose. The limitations of liability provided in this Agreement take effect to the benefit of Aunicaj, and/or its Suppliers.
